Who is the importer?

The nominated owner on customs entries is the importer. NICNAS considers the person who has property of a chemical at the time it is landed in Australia as the importer of the chemical. The next question would be how do we determine when property of a chemical passes, or who the owner is at the time of importation. To answer this, we need to know the details of the arrangements between all the parties involved. Such details usually appear in the contract of sale. However, NICNAS is not in a position to analyse contracts of sale for companies and therefore takes the nominated owner on customs entries as the importer.
