In 2005-06, 201 chemicals fell due for listing on AICS on the basis of new chemical certificates issued five years earlier. Of these, notifiers sought listing on the confidential section of AICS for 33 chemicals. In considering the case for confidential listing, the Director must weigh the commercial interest against the public interest. NICNAS has a Technical Advisory Group (TAG), which provides advice to the Director on this process (see Appendix 16).

Of the 33 applications, the Director granted confidential listing for 25 chemicals and there are seven pending applications. The three-year trend in outcomes for confidential listing applications is shown in Figure 11.
